Procedure for Filing and Registration

Briefly, the procedure for filing and registration of a claim is as follows:

  1. every claim shall be made in Form 1 which can be obtained free from the Tribunal’s office at the addresses listed from page 11.
  2. Form 1 must be completed in 4 copies by the Claimant and filed in the nearest office of the Tribunal:
  3. the filing fee for Form 1 is rm5.00 and an official receipt will be issued to the Claimant:
  4. Form 1 will be registered dated and signed by the secretary or an assistant secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 1 that have been affixed with the seal of the Tribunal shall be returned to the Claimant for service:
  5. service of Form 1 to a respondent may be affected in any of the following manner:

    In the case of an individual

    1. leaving the document with that person: or
    2. giving the document to that person; or
    3. posting the document in a pre-paid registration letter addressed to that person at his address for service or his last known address.

    in the case of a company or a firm :

    1. leaving the document with the director, manager, secretary or other similar officer of the company or the proprietor of the firm;
    2. giving the document to any of the persons mentioned above; or
    3. posting the document in a pre-paid registered letter addressed to any of the persons mentioned above at the registered office of the company or firm or at its address for service.
  6. a Respondent who receives a sealed copy of Form 1 from the Claimant shall, if he disputes the claim, file his defense or defense and counter-claim (if any) in Form 2 which can be obtained free from the Tribunal’s office.
  7. Form 2 must be filed in 4 copies at the same Tribunal’s office where Form 1 was filed within 14 days after the receipt of Form 1 by the Respondent:
  8. the filing fee for Form 2 is RM5.00 and an official receipt will be issued to the Respondent;
  9. Form 2 will be registered, dated and signed by the Secretary or an Assistant Secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 2 that have been affixed with the seal of the Tribunal shall be returned to the Respondent for service of one copy to the Claimant in accordance with paragraph (e)
  10. a Claimant who receives a sealed copy of Form 2 shall file his defense to a counter-claim (if any) in Form 3 which can be obtained free from the Tribunal’s office;
  11. Form 3 must be filed in 4 copies at the same Tribunal’s office within 14 days after the receipt of Form 2 by the Claimant. There is no filing fee for Form 3.
  12. Form 3 will be registered, dated and signed by the Secretary or an Assistant Secretary of the Tribunal and affixed with the seal of the Tribunal. Two copies of Form 3 that have been affixed with the seal of the Tribunal shall be returned to the Claimant for service of one copy to the Respondent in accordance with the paragraph (e).
